Demystifying Contract Terms

Assisting to reduce any skills gaps within the in-house delivery teams

It is not uncommon for clients to find themselves entering into unfamiliar forms of contract with heavily amended contract terms. Such decisions are often uncontrollable and can be dictated by certain market conditions or employer requirements. If the terms are unfamiliar, this can lead to potential exposure and contractual risk.

We understand the complexity of construction/engineering contracts and where risks may often arise. Our specialist team is able to stress-test the contract for weaknesses, gaps or inconsistencies that should help mitigate future risk. We map out the risk and responsibility matrix from the contract so that the client team is aware of its rights and obligations.

Our team can further provide tailored training workshops. The training workshops are designed to provide real life situations (gaming) or from the client’s contract or to highlight key commercial and contractual risks and help the commercial/project team to better manage and understand the commercial obligations. Our bespoke contract gaming and training solution provides a toolkit to help with contractual risk and can support optimum contract performance.

Tailored training solutions

Our team can offer tailored training solutions primarily on the following forms of contract:

  • FIDIC forms of contract (1999 and 2017 amended 2022 editions) of the Red, Yellow, Silver forms;
  • FIDIC Client Consultant Agreement (White Book);
  • Short Form Contract (Green Book)
  • NEC 3 and 4 ECC forms of contract;
  • JBCC Principal Building Contract.

We are able to also provide training on client’s bespoke contracts. Our contract gaming and training solutions offering can be provided at any stage of the project and are designed to provide the knowledge and understanding to the project team for improved contract performance.
The aim of the training is to demystify the contract terms so that they are understood and lived by the client team.
