Claim Avoidance

Assisting clients to reduce the possibility of claims and disputes

Notwithstanding the best efforts of teams, construction projects do not always proceed as planned. Projects change greatly during the project life-cycle and can impact progress, risks, and cost challenges during each stage.

As part of this service our team often review the contract terms to understand the risk and obligations of each party. This provides the cornerstone by which our team can start the assessment of the challenges faced by the project.

We aim to resolve construction disputes during any phase of the construction project with an aim to avoid dispute escalation. We work with Clients to ensure that the pre and post contract activities are executed correctly, providing an appraisal of risks whilst working to formulate the project brief and specific requirements.

Our team can put measures in place that provide a flow of information which help reduce the scope for claims.

How we assit

Claim Assessment

Our team review the contract terms to understand the rights and obligations provided by the contract terms. This provides the base for the next phases of the assistance.

Claims Management

Where claims have been submitted, we assess the strengths and weaknesses of a claim and the entitlement provided by the contract and provide suggestions or strategies for the resolution of the claim.

Claims Avoidance

An ongoing process that starts from the beginning of the project and involves our team assisting all parties to avoid problems and difficulties as and when they arise.

Risk Profiling

An assessment of the client’s risk profile can be performed to map out any gaps between the contractual obligations and the client’s internal governance that may impact performance.

Killing it... it get to the point

Our team provide, assess and manage the relevant commercial issues to understand the level of risk and entitlement arising from each event or events. When reviewing or considering a claim, our morbidly named “RIP” process is simple but effective.

R

Review

The discovery phase where all the relevant and available information is gathered for assessment.

I

Interrogate

The discovery phase where all the relevant and available information is gathered for assessment.

P

Propose

We provide a summary report of the findings and propose the options and strategies available to the client.

The RIP process can be provided at any project stage and is designed to test and evaluate project performance and reporting information provided by the relevant parties. To determine if the relevant risks and contingency provisions are in line with current and anticipated risks and the contract terms. RIP can provide a high-level overview or can focus on specific issues that have arisen to determine any potential knock-on impact to the wider project. The output of a RIP is that we can provide improved recommendations with clear timelines and responsibilities and provide follow-up on recommendations to assess effectiveness of changes.
